I can't wait to read the next chapter as it will likely done from a hospital with a judge and the goons for preliminary hearings as they won't be running too far or fast given their injuries. Let's have Dawn rest up while Marty gets his fans to take the field and do their best to support the guys and the businesses that are supporting Dawn and The Vortex. Loved the intensity in this chapter, once again one the queens of the cliffhanger has brought us to the edge again and left us there. Get well soon Dawn!

Sufficient unto the cause

I believe there is more than enough to bind them over for trial without Dawn having to appear or the defendants needing to physically appear It can by done by video for the defendants. I'm wondering when the trial will start. Each of the douche bags will have an attorney, they will want to meet and coordinate their defense strategies. Not sure if they will go for trying each one separately or all together. There are advantages either way for both sides. So it will at least be a month until the trial, if not longer.

Shaw's piece on the side may come to her senses and call the police. All to the good but that will delay the hammer of justice for Shaw. They can still try him for the attempt murder but he has a whole laundry list of charges from his church scam. For any EGS fans maybe we can get Susan to manifest her hammer one more time. ;-)

The defense may want to move for a change of venue. With Dawn being as popular as she is, once the word of what happened to her gets out, it might be tough to find an impartial jury.

Wonder ....

... if the feds could be involved after seeing and hearing the tape from Dawn's car. I think the comments towards Ren also would make this incident a hate crime and thus a federal case and away from the locals that allowed Daniels out in the first place.

California's Hate Crime Legislation...

...ought to apply here, if they can prove it -- no need to involve the feds, who normally don't step in unless state laws (or those who enforce them) don't cover the situation, or a multi-state hate group is involved.

But I don't know that they'd be able to prove a hate crime to a jury's satisfaction. This was an act of revenge on the perps' part, not a random TG-bashing. Just because there's evidence that they hate the victim's perceived identity group, that doesn't mean that it's necessarily a factor in the attack. The authorities have felony charges to prove here and there's evidence that the crime was premeditated; I'm inclined to doubt that they'd make their job more difficult by also trying for a hate crime enhancement or a separate hate-crime charge.

Didn't they have some sort of restraining order out on Terence Shaw for instigation of animosity against Dawn?

Casey Daniels escaped from the DOC to commit a similar crime that he was in for in the first place, as for Richard Stillman he is in loco parentis for Daniels and been attempting to stop him, not being involved.

Either way I'd say they have them on attempted murder and possibly some sort of conspiracy on top of that, Shaw I guess that part of his bail conditions for the other charges would be to sure he stay away from felons.

With the perps yelling "THERE! DRAG THAT FREAK OUT!", and "BREAK ITS JAWS AND TEETH! SILENCE THE LITTLE DEVIANT!", I would expect the DA would add hate crime charges. I would hope so anyway.

It might be that the authorities use the local charges to keep them behind bars while they further investigate the Federal charges.

The State Crimes Committed...

...including felony assault and attempted murder carry strong penalties. The state could augment those by charging it as a hate crime. The feds normally step in only when the state can't or won't, or when an organized multistate hate group is involved. (Here's one analysis from an online law firm.)

But a hate crime isn't defined as a crime against someone you hate; it's a crime committed BECAUSE you hate some group or category of people. And that, arguably at least, isn't true here.

Shaw went after the station long before he knew Lux Noctis was a DJ, let alone transgender. The wrestlers went after Dawn because her actions had led to one of them going to jail, sanctions against the coach and the team discredited. (I need to go back and re-read, but my recollection is that the administration didn't go through (yet) with their threat to disband the team and fire the coach. If I'm wrong and they did so, all the more reason.)

IMO, it'd be tough to prove otherwise beyond a reasonable doubt, no matter how many audio tapes you introduce in evidence, and since the authorities seemingly have them dead to rights on the substantive charges, I can't see where they'd prosecute on that one. The only reason I can see to charge them with a hate augmentation is to improve their position in a plea bargain negotiation by removing it later -- and I'm not inclined to believe this case is going to be plea-bargained down.

Same discussion

I've had this same discussion elsewhere, pertaining to whether or not something was a hate crime. Like you, I argued that some people use certain words or phrases commonly, so should they use them in a situation where they might actually apply it isn't proof that their actions were out of hatred for a certain minority.

Much like people that use the term "motherfuckers", they are not actually accusing somebody of being one. It is just a term they use when they are angry. I don't know how it will work out here, adding that charge is at the DA's discretion. It might be added just to give the DA something to bargin with, but I think and hope that Dawn and Marty will turn down any plea bargaining. That leaves the DA with a charge he may not be able to make stick. And most DAs don't like to file charges they can't support.

But as you might have guessed, I agree with you about whether something is a hate crime or not. In fact, most of this comment makes the same arguments as yours. But I'll leave it as a supporting opinion. Mostly I wanted to voice my agreement with you about defining a hate crime, as most people I know use a broader interpretation of the term.

Wrestling Team Disbanded

Chapter 14 - The wrestling team was disbanded and the coach laid off. The superintendent said there would be no wrestling team at the school for 5 years.

"Marty saw the bruise and made a call. After which he told Dawn that the wrestling team was disbanded and the coach laid-off."

There is corroboration later in the chapter.

Last two chapters should be straightforward then - with them gone and Cliff driven out of town, Dawn has no real opposition left.

Hate crime

After more research I now tend to agree prosecutors would not consider it a hate crime.

that the cane might come in handy, but thank god for the boys being close enough. Glad the attackers got all they gave and so much more. Lady Snow you have written a chapter here that many can relate to. Sounds like the hillbilly side of old West Texas while I was growing up (a boy unfortunately) where my sister almost outed me.

I am sure that all will work out in the end. When Casey goes back maybe he could find out what it like to be some one's girlfriend. If I where a cop I would let it out that he and his friends jumped a defenseless woman then the fun can begin for all including Shaw and the Coach. It would also be nice it on her return the school and athletic teams gave her a special reception both at school and work, maybe even her whole dedication hour people call in dedications to her.

Although a less painful method is preferable to most of us, at least they caught them before something dire happened. Maybe now they can finally land some charges on them, and deny bail, seeings as they are showing signs of repeat offenders. Take the Trash out for good.

So Frustrated

I came home frustrated by a talk from Ta Nahesi Coats, who spoke on civil rights issues. And I got accused of having white savior syndrome, so the evil taste of hatred is still in my mouth.

I've been a cop in the Military, and seen people like her attackers, I'm pretty sure that were I involved, there would be some dead people by morning.

One Missing

Everytime I reread a new chapter of a story I pick up on things I didn't notice previously. Which leads me to the one person missing. Angela. I know the word probably hasn't had a chance to get to her, but will this bring about her reappearance? I think it would almost be mandatory for her and her mother to put in an appearance at some point. In spite of the recent events they have known Marty and Dawn for a long time. Surely Angela can bury her resentment long enough to pay Dawn a visit. This might be the wakeup call she needs to fully take onboard the reality of Dawn's fears.

I hope this finally hangs them all. From their comments and most likely the video from the car security system camera; I can see charges of attempted murder, grievous bodily harm, First Degree Assault (ramming the car with their trucks), Assault and Battery with the intent to do great bodily harm, (which would bring it up to a felony level); plus adding HATE crime to each charge all being leveled on all of the jerks.
The DA may come up with a few more as well.
Hoping this puts them away for a very, very, very long time.

Dawn was really lucky, was sad to see that they managed to attack her before being found.
Still She has survived and I have no doubt be a lot stronger for it? although I am sure there will be a few nightmares.
I am sure that casey and his friends are feeling the pain pity the cops stopped them a little to early?
So now shaw will be back in the grey bar motel as well as the coach.
Casey will have all his friends with him aswell although I am sure he will find out that he really isn't such a big man after all.
Hmmmm that nurse really screwed up her career I vry much doubt she will be nursing any longer?
I cannot wait to see just how Shaw and the rest are going to try and spin this esp with the security video from Dawn's car.

Which they did, but they got caught in the act. Poor Dawn was the victim but seems to have survived,even though she was severely damaged.

Still a great action chapter and the arseholes will get their just desserts. Love the story.

Stupid people are just plain stupid. And they paid for being stupid.

Hurt a loved person and that triggers a very aggressive response. Those with major breaks got off lucky, they could be dead. Two elbows to the throat makes it hard to breathe, especially after getting a knee to the groin. That alone would take the wind out of any guys' sail. And what Ren did to his guy, arthritis in the shoulder is in that guys future. The bad guys got their butts kicked big time. And it's all on tape, thanks to the security system Marty put in Dawn's car. Those guys are dead meat.
